Dear Sir,
Super performance by PHI officer on Derana TV to insult the Muslim Community but earlier On a different program DIG Ajith Rohana stated that Corona started in this country in October last year which is correct but today the PHI is creating a big problem with the majority community saying that we can’t celebrate Sinhala New Year because of these Muslims.
This kind of serious hatred speech is a clear violation of the provisions of ICCPR Act No.56 of 2007.The freedom of expression is constitutionally recognized under article 14 of our constitution. However, this is not an absolute freedom. Under article 15 of the constitution very clearly demonstrates the Circumstances where the freedom of speech could be restricted. The circumstances set out in article 15 Manifestly demonstrates that the freedom of expression recognized by the article 14 is not an absolute right. Therefore any person who delivered any kind of hatred speech or who publishes any article or share (telecasts)articles which would incite another to discriminate or take to hostile and violence means bad on national, racial or religious hatred would be guilty of an offence under section 3(1)of the ICCPR act No.56 of 2007.As you know a person arrested in respect of an offence under section 3 cannot apply for bail in a magistrate's court. Bail can only be granted by
Th high court on exceptional circumstances in terms of section 3(4) the act.All offences under this act are triable by the High court and upon conviction an accused becomes liable to be punished with rigorous imprisonment for a term not exceeding 10 years.
